A dissolution is an agreed proceeding in which the parties negotiate the terms of the termination of their marriage through their attorneys. Once an agreement has been reached, the necessary paperwork is drafted for the parties’ signature and is filed with the Court. A final hearing is held which is generally a very quick proceeding lasting no more than ten to fifteen minutes and the marriage is terminated that day. |

A divorce is a contested proceeding in which the parties do not agree either to terminate the marriage or the terms upon which the marriage will be terminated. The process of divorce begins with the filing of a Complaint. During the course of the litigation, the court can issue Temporary Orders to either party. A divorce proceeding will require a number of court appearances and can take up to 18 months before final orders are issued. |

An annulment differs from a divorce or dissolution in that a divorce or dissolution ends a legally valid marriage whereby an annulment declares the marriage illegal in the first place. While the process of annulment will declare a marriage illegal or void, an annulment does not affect the legitimacy of children. |

A legal separation is a proceeding by which the rights of the parties are determined and established on issues relative to the termination of the relationship and the parties are essentially treated as though they are divorced, although, legally still married. The process of legal separation is most widely used in circumstances where religious beliefs prevent the parties from being divorced or where elderly or military personnel are involved and one party cannot afford to lose the health insurance benefits of their spouse. A legal separation does not prevent either party from later filing for a divorce. |

Having the questionnaire completed prior to the initial meeting will be beneficial to you, as our attorneys will be better prepared to determine your legal needs after reviewing your answers to the questionnaire. If you intend on meeting one of our attorneys for an initial consultation, please feel free to have the questionnaire delivered to you in advance, either by mail, fax or email, simply by requesting the questionnaire at the time that you schedule your initial consultation
In addition, please bring the following:
- Three years tax returns
Statements (last 3 months) from all financial accounts
- Statements (last 3 months) for all investment/retirement accounts
- Deed to real estate; Title to all automobiles
- List of property you owned prior to the marriage.

“Spousal Support” means any payment or payments to be made to a spouse or former spouse, or to a third party for the benefit of a spouse or a former spouse, that is both for sustenance and for support of the spouse or former spouse. In divorce and legal separation proceedings, upon the request of either party and after the court determines the division or disbursement of property, the court of common pleas may award reasonable spousal support to either party. During the pendency of any divorce, or legal separation proceeding, the court may award reasonable temporary spousal support to either party. |

“Shared Parenting” is when both parents are designated the legal custodians of their child(ren) and have agreed to equally share in the child(ren)’s upbringing, despite the termination of their marriage or relationship. A Shared Parenting Plan is proposed by one or both parties or ordered by a court, and outlines each parent’s rights and responsibilities relating to their child(ren). Such a Plan shall include, but is not limited to, a parenting time schedule, an order for the payment of child support, an order designating one parent to be responsible for providing health insurance benefits for the child(ren), an order designating one parent as the school placement parent and the right to claim the child(ren) as an income tax dependency exemption. |
